1. Data protection responsibility
Gamigo AG, parent company of the gamigo group, shall be responsible within the meaning of Art. 4 No. 7 of the General Data Processing Regulation (GDPR) and other provisions of data protection law. The person responsible is the natural or legal person, authority, institution or other body which alone or jointly with others decides on the purposes and means of processing personal data.

2. Processing of personal Data
The provision of personal data on the Internet always carries the risk of unauthorized processing by third parties who gain unauthorized access to this data, since no technological system can be completely protected against external attacks.
We take the greatest possible technical and organizational measures to protect your data from misuse. We process your data in accordance with the requirements of German and European data protection law and continuously train ourselves to protect your data at all times and from the time of collection.
3. Scope and purpose of the processing
We collect and process personal data as a matter of principle only to the extent necessary to provide a functioning website and our content and services.
User information referred to as personal data includes all information about a person and their factual and personal circumstances, such as name, address or age. Statistical data collected in addition which cannot be assigned to a specific natural person are not personal data.
We treat your data confidentially and in compliance with the statutory data protection regulations and will not pass them on to third parties without your consent, unless this is necessary for the execution of a contract or with legal permission.
3.1. Usage of our website and creation of logfiles
Every time you visit our website, the system automatically collects data and information from the computer system of the calling computer.
These are:

– URL of the referring Web site from which a file was requested
– Date and time of access
– Browser type and operating system as well as hardware information

The data is stored in the log files of our system.
The log files enable us to ensure the functionality of our services. We use logfiles to optimise our websites and to ensure the security of our systems and compliance with the terms of use and rules of the game.
With the help of log files we can prevent misuse and provide relevant log files to investigating authorities in individual cases.
3.2. E-Mail Services and Newsletter
If you register with us for a game, we will use the e-mail address you provided during registration to inform you by e-mail about your account within the scope of your contract, e.g. about payment confirmations or if you have changed your password.
In addition, we will inform you about similar products by newsletter. You can unsubscribe from receiving the newsletter at any time free of charge via the link contained in the newsletters.
Newsletters are sent by service providers on behalf of gamigo. Images and graphics in the newsletters are retrieved from the gamigo servers when they are opened. In addition, newsletters contain so-called tracking pixels. These are pixels that correspond to a file that is retrieved from the server of the shipping service commissioned by gamigo when the newsletter is opened. When the sent newsletter is opened, information is also transmitted to our service providers, which they evaluate statistically and which serve to optimise the technical and content aspects of gamigo’s services. The information transmitted includes, for example, the anonymous IP address of the respective user as well as the language, hardware and handling of the newsletter, i.e. when it was read and which links were clicked.
3.3. Cookies
When you visit our pages, we want to arrange your visit in such a way that you always receive the information most relevant to you, which is why we use cookies on our pages.
Cookies are small text files that are stored on your terminal device. They ensure that we recognize you when you return to our websites and can offer you our websites tailored to your needs.
There are permanent cookies that remain stored for a longer period of time and so-called session cookies that are only set for the duration of your visit and are deleted when you leave.
We and our service providers use the following cookies:
a. Mandatory cookies – are used so that we can correctly display our pages to you and to make your visit to the site easier, for example by temporarily storing your transactions.
b. Performance and feature cookies – are important to us in order to monitor your visit to our Sites and to avoid error messages.

4. Legal basis of the processing
4.1. Registration and use of the Game Service
By registering for our gaming services, you enter into a contract with us and this contract is to be processed through use. The collection of your data within this framework therefore serves to fulfil the contract, so that the legal basis for the processing results from Art. 6 (1) (b) GDPR.
4.2. Creation of log files
The legal basis for the creation of log files and the temporary storage of these data is Art. 6 (1) (f) DSGVO, because the interests, fundamental rights and fundamental freedoms of the data subject do not outweigh the legitimate interest of gamigo or a third party in their processing.
4.3. Newsletter Dispatch
The legal basis for the dispatch of our newsletter is based on § 7 paragraph 3 UWG or on your consent, depending on the type of newsletter.
You can unsubscribe from receiving the newsletter at any time or, if you have given your consent, revoke it for the future at any time and without stating reasons. You may unsubscribe to datenschutz@gamigo.com or at the link shown at the end of every mail.
4.4. Cookies
The legal basis for the processing of your personal data is Art. 6 (1) (b) GDPR, if these serve the fulfilment of the contract, such as in the case of system cookies.
The legal basis can also be Art. 6(1)(f) GDPR if the processing is necessary to safeguard the legitimate interests of gamigo or a third party and the interests, fundamental rights and fundamental freedoms of the data subject do not prevail.
The legal basis can also be your consent if you have made a corresponding setting on our website. This consent is revocable at any time and without giving reasons for the future in the cookie settings.
5. Storage duration and deletion concept
We store your personal data only for the duration of the respective purpose. As soon as the purpose of the storage is fulfilled, we delete your personal data according to the legal deadlines.
6. Data security
We have implemented current measures to ensure data security and to protect your personal data from the dangers of data transmission and from disclosure to third parties. We also regularly check whether the security measures are up to date.
We take the greatest possible technical and organizational measures to protect your data from misuse and transmit your data encrypted using the SSL procedure. We process your data in accordance with the requirements of German and European data protection law and continually train ourselves to protect your data at all times and from the time it is collected.
7. Third party services
For certain reasons gamigo will pass on personal data to third parties. This is necessary for the fulfilment of contracts and serves to process payments, prevent fraud and manipulation and fulfil legal obligations.
Any transfer for purposes other than those stated shall only take place with the consent of the person concerned.
In order to ensure that the personal data is adequately protected, corresponding agreements are concluded with the third party providers in accordance with Art. 23 para. 3 GDPR.
These also stipulate that data transferred will be used exclusively for the fulfilment of contractual tasks and in particular will not be disclosed without permission. Compliance with the technical and organisational measures pursuant to Art. 32 GDPR is to be guaranteed.
Where data is transferred to a non-certified third country, compliance with Art. 44 et seq. GDPR is ensured. Currently, the use of the standard contractual clauses issued by the European Commission is used for this purpose in accordance with Art. 46 para. 2c) GDPR.
In order to improve our offer and to personalise it, we also use analysis services of third parties. These are implemented directly on our pages. The data collection is then carried out by the person responsible for the service itself. Technical user data is collected, whereby the IP address is shortened in such a way that the data after collection is no longer personal data. Anonymous user profiles are created. Without the consent of the person concerned, no personal reference can be made to a user profile.

Customers who wish to object to their data being processed can send this objection to the contact details above by email or by post. This also applies to exercising any rights to information, to correcting, deleting their data or limiting the processing of their data, as well as the right to transfer their personal data. If consent has been given to process the personal data, then this may be withdrawn at any time and apply to the future. The legality of any consent granted for processing data prior to such an objection being received shall remain unaffected.
